1. General information Pasaia City Council
These General Conditions (the "General Conditions") regulate the procedure for purchasing tickets on the website hosted under the domain name Pasaia Itsas Fastibala (the "Website") and under any of the sub-domains or web pages dependent on it, as well as the contents and services that the owner of the Website makes available to its users (the "Users") and establish, together with the privacy and cookies policy, relating to the management of Users' personal data (the "Terms of Use"), the terms and conditions governing the Website (the "Terms and Conditions").
The use of the website attributes the condition of User and implies acceptance of the provisions included in these General Conditions of Purchase and in the Conditions of Use ("Terms and Conditions") in the version published by Pasaia Town Council at the same time as the User accesses the website.
In compliance with article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, the following details identifying the owner of the Website are set out:

Access to the Website or its use by the User necessarily implies, without reserve, knowledge and acceptance of the Terms and Conditions. Therefore, it is recommended that the User reads them carefully each time he/she wants to access the Website.
The User declares that he/she is of legal age and has the necessary legal capacity to act and contract on the website in accordance with the present conditions, which he/she declares to understand and accept.
Pasaia Town Council has created a ticket purchase and sale tool on the Website through which it offers its Users the "Ticket Purchase Service".
2. Service for the purchase of tickets
- Description
Pasaia Town Council provides its Users with a ticket purchase service through which Purchasers can quickly and easily purchase tickets for the Events published on the Website by the Organisers.
All purchases are governed by:
● These General Conditions of Purchase.
● Any special terms and conditions that may be published on the Website.
● The terms and conditions of the Organisers and/or the Event, which may be available on their respective websites.
-Ticket sales and collection channels and methods of payment
There are different options for purchasing tickets:
● Website via the Internet.

Physical points of sale with which Pasaia City Council has distribution agreements.
Forms of payment:
● Online.
Purchases may incur non-refundable handling and delivery fees, which will be specified before the purchase process is initiated.
- Confirmation of purchase
If the purchase has been made correctly, the Buyer will receive a confirmation e-mail with detailed information about the purchase that has just been made.
- How to access the event
The Buyer will be able to access the Event with the ticket, in the aforementioned media, at the Event entrance where the ticket will be validated. Even if several copies of the ticket are replicated, only the first ticket presented at the entrance will be considered valid, and those who subsequently try to enter with the same ticket will not be allowed to do so under any circumstances.
- Admission and attendance
The Venue reserves the right to refuse admission in the case of any breach by the Buyer of any of the terms and conditions of the Event or the Organiser. Ticket(s) are issued in accordance with the rules and regulations of the Venue and the Event Organiser, which will be available to the Buyer at the Venue Box Office. Full details will be available to the Buyer at the Venue Box Office. Breach of any of the said rules and regulations, or any other act which may cause damage, harm or injury, shall entitle the Venue or the Event Organiser to expel the Buyer from the Venue. In any case, Pasaia City Council recommends and refers the Buyer to the rules established, in each case and for each Event, by the Organiser of the specific Event at any given time.
Both the Purchaser and other ticket holders consent to the recording of images and sound as part of the audience.
- Conditions of Ticket Service

Illegal resale of a Ticket or attempted illegal resale of a Ticket constitutes sufficient cause for the confiscation or cancellation of such Ticket without the right to a refund or any other form of compensation.

A Ticket may not be used for advertising, commercial, promotional, gaming, competition or betting purposes without the prior, express and irrefutable authorisation of the Organiser.

The Event may be recorded for commercial and/or promotional purposes, whereby Buyers give their consent by accessing the Event so that their image may be recorded and subsequently reproduced for the aforementioned purposes as part of the public.

The Organiser reserves the right of admission to the Event.

The Organiser is legally entitled to carry out appropriate checks and searches to verify that security conditions within the Event are met.

Any crumpled, torn or falsified tickets will authorise the Organiser to deny the bearer access to the Event.

Pasaia City Council accepts no responsibility for the loss or theft of the ticket.
3. Refunds
- Refunds
Occasionally, Events are subject to cancellation, change of date or substantial alteration by the venue, the artist or the Organiser for a variety of reasons.
Once the ticket has been purchased, it will not be exchanged or refunded, except for reasons provided for in current legislation.
The impossibility of attending an Event or the making of an error in the purchase of the ticket/s are not grounds for a refund. In accordance with current consumer and retail trade regulations, the Buyer may not exercise the right of withdrawal or cancellation, in accordance with current consumer and retail trade regulations.
It is the Buyer's responsibility to check if an Event has been cancelled or suspended, or if the date and time of the Event has been modified. However, in these cases, Pasaia City Council will use the means reasonably available to it to inform the Purchaser of the event in question, after receiving the corresponding authorisation from the Organiser. However, Pasaia City Council does not guarantee that the Purchaser will be informed of the incident that has occurred prior to the date of the Event. Any changes that occur in the Event after the start date of ticket sales are the sole responsibility of the Event Organiser.
- Cancellations
Cancellations of Events or changes that occur after the Buyer has received confirmation of purchase of the ticket/s, such as changes of date, venue, artists, are the sole and exclusive responsibility of the Organiser, and therefore Pasaia City Council may only and exclusively proceed to cancel the tickets and, therefore, refund the price when it receives an express order from the Organiser of the Event.
In the case that the Organiser decides to refund the price, this will be reimbursed by Pasaia City Council by the same means of payment used for the purchase, within fifteen (15) working days from the date of public notification of the cancellation of the Event.
Pasaia City Council may only and exclusively proceed to the cancellation of the tickets and, therefore, to the refund of their amount in the case of cancellation, change of dates, etc.

In the case of cancellation of the Event after more than half of the Event has taken place, the Purchaser will not be entitled to a refund of the ticket price.

Bad weather conditions do not entitle the Buyer to a refund of the ticket or the ticket price.
- Change of Date
Unless otherwise stated in relation to a particular Event, if the date of the Event is changed, the Purchaser will be offered locations (subject to availability), of a value corresponding to the original tickets. In the case that the Purchaser informs Pasaia Town Council that he/she will not be able to attend the Event on the new date, the Purchaser will be offered a refund of the sale price of his/her ticket(s), including the corresponding handling fees per ticket, if so authorised by the Organiser.
- Substantial Alteration
If an Event is substantially altered, the Buyer may choose to confirm their corresponding order for the altered Event, or request a refund of the purchase price of their Ticket(s), including the corresponding booking fee per Ticket, within the timeframe fixed. In the case that you do not notify us of your decision, the relevant order for the altered Event will be confirmed and you will not be entitled to claim a refund. A " substantial alteration" is a change that, in the reasonable opinion of the Organiser, causes the Event to differ substantially from the Event that Ticket Purchasers could reasonably expect. The use of understudies in theatrical performances and/or any kind of changes to: (i) any opening act; (ii) the members of a band; and/or (iii) the line-up or formation of any Event involving multiple artists (such as a festival) shall not be deemed to be a material alteration.
- How to request a refund
To request a refund, the Purchaser must send their request in writing to: Ayuntamiento de Pasaia, San Juan n.º 19, 20110, Pasaia (or to any other communicated address). He/she must accompany the unused tickets and follow any other reasonable instructions given to him/her. For accounting purposes, unused tickets must be received within 15 days of the date of the cancelled or suspended Event. After this period, no refunds will be accepted.

4. Closure of user accounts and suspension of the service
Pasaia Town Council reserves the right of admission and exclusion from the Web Site. Any User who does not comply with the aforementioned rules may be excluded from the Website.
Likewise, Pasaia City Council may withdraw or suspend the provision of Services at any time and without prior notice to Users who fail to comply with the provisions of the Terms and Conditions.
5. Modifications to the general purchasing conditions
Pasaia Town Council reserves the right to modify the present General Purchasing Conditions, which it will duly inform on the Website, and therefore recommends that the User reviews them periodically.
6. Legislation
These Conditions of Purchase have been drawn up in accordance with the provisions of Law 34/2002 of July 11, on Information Society Services and Electronic Commerce, Law 7/1998 of April 13, on General Contracting Conditions, Royal Legislative Decree 1/2007 of November 16, approving the Revised Text of the General Law for the Defence of Consumers and Users, Law 7/1996 of January 15, on the Regulation of Retail Trade, and any other applicable legal provisions.
7. Applicable law and jurisdiction
The Terms and Conditions are subject to Spanish law. For the resolution of any conflict that may arise from accessing the Website, the User and Pasaia Town Council expressly agree to submit themselves to the competent Courts and Tribunals.
